Privacy Policy
Privacy refers to the information we collect during your visit on this website.  This Privacy Policy outlines how we use the information we collect.  While you’re enjoying this site, you may be asked to provide your name and email address—specifically, if you choose to opt-in to our newsletter.  Sharing your name and email address is completely optional, but please note: should you choose not to provide your name and email, access to certain activities on this site may not be available to you.  If you choose to opt-in to our newsletter, your name and email will be stored by Convertkit, a third party service we use to manage, create, and send newsletters. You can read Convertkit’s privacy policy by clicking here.   We hope you’ll find my newsletters helpful and informative; they include inspiration, news, Michelle’s teaching schedule, marketing and promotions for the services we offer.  You can unsubscribe anytime from our newsletter by simply clicking the Unsubscribe link at the bottom of any newsletter.  Michelle Wert/Wert Creative LLC will never sell or share your information.
 

If you choose to sign up for the Membership portion of this website, we collect information you voluntarily provide in order to offer our services to you, including your name, email address, physical address and telephone number.  Payments for services on the Membership portion of this site are accepted through PayPal.  You agree not to share your login and password information and understand that you alone have the right to access the content you have chosen to access.

Michelle Wert/Wert Creative LLC is hosted on the Wix.com platform. Wix.com provides us with the online platform that allows us to sell our products and services to you.  Your data may be stored through Wix.com’s data storage, databases and the general Wix.com applications. They store your data on secure servers behind a firewall.  You can access Wix Privacy Policies here.  All direct payment gateways offered by Wix.com and used by Michelle Wert/Wert Creative LLC adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

We may contact you to notify you regarding your account, to troubleshoot problems with your account, to resolve a dispute, to collect fees or monies owed, to poll your opinions through surveys or questionnaires, to send updates about our services, or as otherwise necessary, to contact you to enforce these Terms, applicable national laws, and any agreement we may have with you.  For these purposes we may contact you via email, telephone, text messages, and postal mail.

We collect such voluntary, Non-Personal and Personal Information for the following purposes:

1. To provide and operate the Services herein;

1. To provide our Clients with ongoing customer assistance and technical support;

2. To be able to contact our Clients with general or personalized service-related notices and promotional messages;

3. To create aggregated statistical data and other aggregated and/or inferred Non-personal Information, which we or our business partners may use to provide and improve our respective services;

Terms, Conditions & Cancellation Policies
For any Membership services that enable you to access, view, or use the content herein, we grant you a limited, revocable, non-exclusive, non-sublicensable, non-transferable access and use of the content for your personal, non-commercial use only.  None of the content created by Michelle Wert/Wert Creative LLC may be shared, or distributed at any time.  You agree not to share your login and password information and understand that you alone have the right to access the content you have purchased.  

Cancellation & Refund Policies
All sales are final. There are no refunds, transfers, or exceptions made.   If you choose to sign up for the Membership portion of this website, you gain instant access to all content in the class library, as well as access to live classes for the duration of your paid Membership. There is no obligation to commit beyond the Membership you paid for.  To cancel future charges, simply login to your account and cancel under your Membership Account.  You will not be charged again.  Please note that there aren’t refunds for partially unused membership periods.  There are no refunds for memberships, however, you can pause and resume memberships at any time.  Login to your account to edit your Membership access.

 

Waiver

Michelle Wert/Wert Creative LLC recommend that you consult your physician regarding the applicability of any recommendations and follow all safety instructions before beginning any exercise program.  When participating in any exercise or exercise program, there is the possibility of physical injury. If you engage in this exercise or exercise program, you agree that you do so at your own risk, are voluntarily participating in these activities, assume all risk of injury to yourself.  

 

Client (hereinafter “You”/) understands that yoga includes physical movements and activity, as well as an opportunity for relaxation, stress-education and relief of muscular tension.  As is the case with any physical activity, the risk of injury, even serious or disabling, is always present and cannot be entirely eliminated.  If You experience any pain or discomfort, You will listen to your body, adjust the posture and ask for support from the teacher, or discontinue the activity. You will continue to breathe smoothly. If You experience any pain, difficulty, dizziness, illness, or discomfort, during yoga class, stop and consult your physician or seek emergency medical attention immediately. 

 

Michelle Wert/Wert Creative LLC is not a health care or medical provider. Content made available therein, including without limitation any advice, information, workouts, exercises, regimens, or other materials are provided for general informational purposes only, and do not constitute medical advice. Yoga is not a substitute for medical attention, examination, diagnosis or treatment. Yoga is not intended to be relied upon for determining the state of your health or in the diagnosis of any medical conditions and is not, and should not be used as, a substitute for a professional medical evaluation. Yoga is not recommended and is not safe under certain medical conditions.  You affirm that a licensed physician has verified the status of your health and physical condition as sufficient to allow You to participate in the physical activity required by the practice of yoga.  You are responsible to decide whether to practice yoga and your participation is at your own risk.  You assume full responsibility for your body and any and all damages which may be incurred as a result of your participation in the yoga activities. Michelle Wert/Wert Creative LLC will not be liable for any loss or damage, including personal injury and death, arising out of or in connection with your reliance on or use of yoga classes taught by Michelle Wert.  

 

After having read this waiver and knowing these facts, and in consideration of acceptance of Your participation and Michelle Wert/Wert Creative LLC furnishing services to me, I agree, for myself and anyone entitled to act on my behalf, to HOLD HARMLESS, WAIVE AND RELEASE the Michelle Wert/Wert Creative LLC, its officers, agents, employees, organizers, representatives, and successors from any responsibility, liabilities, demands, or claims of any kind arising out of my participation in their yoga classes, training, programs and/or events.

 

Your continued use of the services on this site signifies your continuing consent to be bound by these Terms, Conditions & Privacy Policies.
